Buying a home after divorce is not about starting from zero. It is about showing what changed and documenting the financial picture you have now.

If you plan to buy in Northeast Florida, do not wait until you find a house to sort out the divorce decree, joint accounts, support payments, or a former mortgage.

Can you get a mortgage after divorce?

Possibly. Divorce by itself does not disqualify someone from getting a mortgage.

The application still comes down to documented income, debts, credit, cash to close, property details, the loan program, and lender requirements. A divorce can change several at once, so start with documents.

Start with the final agreement, property, and joint debts

Gather the complete, signed divorce decree, property settlement, and any later court orders.

The mortgage review may need to confirm:

  • What happened to the former marital home
  • Who is responsible for each joint debt
  • Whether support is received or paid
  • Whether a property buyout or sale created purchase funds
  • Whether unresolved property issues could affect the transaction

A divorce decree does not automatically remove a joint debt. The Consumer Financial Protection Bureau explains that a creditor may still treat someone named on a loan as responsible unless that person is contractually released or the debt is refinanced: CFPB guidance on debt after divorce.

For a mortgage file, provide the decree and any documents showing what happened after it, such as:

  • A Closing Disclosure from the sale of the former home

  • Statements or cancelled checks showing who has made the payments

Do not assume that signing a deed removed you from the mortgage. Title ownership and loan liability are different.

  • Complete divorce decree and later court orders
  • Current income and employment documents
  • Recent bank, retirement, and investment statements
  • Support records when relevant to the application
  • Documents for the former home, mortgage, and joint debts
  • Settlement, transfer, and bank records tracing home-sale or buyout funds

Home-sale or equity-buyout funds may help with cash to close, but they need a clear paper trail. Ask your legal or tax adviser whether other issues apply.

Base the target payment on your current budget. Review principal and interest, property taxes, insurance, mortgage insurance, HOA or condo dues, flood costs when applicable, and CDD fees.

What Realtors should confirm before an offer

Realtors do not need private divorce details. Before writing, confirm that the lender or broker reviewed any former-home obligation, current income and debts, cash to close, credit, and the target property's full payment. If a sale, refinance, assumption, or court deadline is still pending, the contract timeline should reflect it.
